AACHEN (dpa-AFX) - The large-scale demonstration planned for Saturday in the lignite area in Lützerath can take place with restrictions after a court decision. This was decided by the Aachen Administrative Court and announced on Friday. The police had demanded from the assembly leadership of "Climate Justice Movement DE" that the starting point of the demo north of the Erkelenz district of Keyenberg be moved at 10:30. In addition, the police prohibited the carrying of ten tractors. Against these requirements, the organizer went to the Administrative Court of Aachen and was partially successful. An appeal against the decision can be lodged with the Higher Administrative Court for the State of North Rhine-Westphalia in Münster (Ref.: 6 L 35/23).

In the summary proceedings, the court confirmed the view of the police in the matter of tractors. During the large demonstration with an expected 8,000 participants, the large agricultural machines were a danger to the demonstration procession. In the case of the relocation of the demonstration, the court did not share the view of the police. The had the immediate danger "not sufficiently credible made". A feared backlog of arrivals on the highway could be counteracted by "traffic-steering police measures" and by instructions to the assembly leaders.

Following rulings by the Aachen Administrative Court on pickets against the mining, appeals against this decision were filed on Friday with the Higher Administrative Court (OVG) in Münster. In the lower court, the relocation of the vigil demanded by the authorities had been classified as permissible. Reason: For the settlement Lützerath is valid since Tuesday a stay and entry ban. The new locations specified by the police within sight of the former Lützerath settlement were proportionate and protected the right to demonstrate. In addition, RWE, as the owner of the land, was against holding demonstrations on its private property.

Since the appeal has not yet been substantiated, it remains to be seen when the OVG will make its decision, a spokeswoman told dpa on Friday./lic/DP/men
