Yesterday, Mr. Sessions rescinded previous advisory guidance issued in the Obama era, which served to direct U.S. attorneys nationwide to refrain from prosecuting marijuana businesses acting in compliance with state law; Mr. Sessions now directs those U.S. attorneys to exercise their own prosecutorial discretion in such matters. Importantly, all of the guidance focused on marijuana enforcement policy, and none contemplated industrial hemp, as industrial hemp is treated as distinct from “marihuana.”
